On May 29, 2013, the U.S. Department of Health and Human Services released final rules regarding participatory wellness programs and nondiscrimination. Wellness rewards increase from 20% to 30% in 2014 and are capped at 50% for wellness programs designed to prevent or reduce tobacco use.

Bruce Davis, Findley Davies Health & Group Benefits National Practice Leader, presented at the Columbus Business First Health Care Reform Summit on January 15, 2013. More than 200 attendees who attended the event participated in several polls weighing in on if PPACA will succeed in holding down health benefits costs. Attendees also voted on whether they will reduce hours to avoid paying FTE health benefits. Opinions on wellness incentives and whether small and large employers will drop health benefits were also captured.

 

Bruce Davis, Findley Davies Health & Group Benefits National Practice Leader, and Gail Steward, Managing Consultant, presented at a Columbus Retirement, Employee Benefits & Health Care Forum sponsored by Schneider Downs and Findley Davies on January 23, 2013.  Attendees received an update on ERISA audit fiduciary responsibilities, best practices for retirement plan sponsors,  2013 Health Care Reform strategies and pension funding strategies for 2013.

One thing is certain, change is constant as employers and employees navigate through the twists and turns of health benefi­ts coverage.

This timeline is intended to cover the highlights of the Patient Protection and Affordable Care Act (PPACA) as it relates to employers and employees. Although PPACA was signed into law on 3/23/2010, this timeline focuses on the aftermath of the Supreme Court of the United States’ decision rendered on 6/28/2012. This timeline does not address fundamental changes impacting Medicare, Medicaid, the health care delivery system, insurers or the states.

New Rules:

• On 12/28/2012, the IRS issued proposed rules on safe harbor methods employers may use to identify FTEs.
• On 1/24/2013 HHS indicated the deadline was extended for employers to provide employees with a notice about the availability of a health insurance exchange in their state but did not provide a specific date or model language for the notice. The original deadline was 3/1/2013 and is now “late summer or early fall." In addition, The Obama Administration announced the term “exchange” will be replaced with “marketplace."

The Fiscal Times released an article on October 8, titled "Open Enrollment and Obamacare: What You Need to Know." This article discusses the impact on women's health provisions, flexible spending accounts, Medicare, Medicaid, and Fees & Taxes.

 

On September 13, 2012, Bruce Davis of Findley Davies presented "Health Care Reform: Impact on Your Business" to business owners at two events in the Columbus market, Beacon Hill B.O.S.S. Workshop and Key4Women event.

 

On August 31, the federal government released guidance on the nation's health care system law.  The guidance defines a “full-time” employee under the shared employer responsibility provisions and describes limitations on health care coverage eligibility waiting periods.

Highlights of Health Care Reform: What does it mean to employers and employees?

 

On December 24, 2009, the U.S. Senate passed the Patient Protection and Affordable Care Act (HR 3590). On March 21, 2010, the U.S. House of Representatives passed HR 3590. President Obama signed HR 3590 into law on March 23, 2010.

 

On January 19, 2010, Findley Davies joined many employers and business organizations in urging Speaker Pelosi and Senator Reid to not merge the House and Senate health care reform bills.

 

On Thursday, December 24, 2009, the Senate voted 60-39 to pass the Patient Protection and Affordable Choice Act. 

 

Findley Davies partnered with the U.S. Chamber of Commerce (the Chamber) to host an audio conference on “Health Care Reform Updates”.

On November 7, 2009, The House of Representatives passed, HR 3962, The Affordable Health Care for America Act. This Act and a side-by-side comparison of current proposals are attached.
